Residency Visas, Work Permits and Citizenship by Investment in Egypt for Expats

The Arab Republic of Egypt has established a modern, highly attractive legal architecture governing foreign residency, corporate executive work permits, and naturalization through investment. Codified primarily under Law No. 89 of 1960 on the Entry and Residence of Foreigners as amended, Investment Law No. 72 of 2017, and Prime Ministerial Decree No. 3099 of 2019 (amended by Decree No. 876 of 2023), this regime allows international investors, business executives, and retirees to obtain lawful status and economic integration through transparent statutory channels.

1. Categorization of Foreign Legal Residency in Egypt

Foreign nationals residing in Egypt for business, employment, or personal residency operate under specific statutory visa tiers granted by the Passports, Emigration, and Nationality Administration (مصلحة الجوازات والهجرة والجنسية):

A. Real Estate Ownership Residence Visa (الإقامة العقارية)

Enacted to stimulate direct foreign capital inflows into the domestic property sector, foreign individuals acquiring completed residential or commercial real estate qualify for multi-tiered residency based on verified overseas capital transfers:

  • Five-Year Renewable Residency: Granted to foreigners acquiring one or more real estate properties with an aggregate transferred value of not less than USD 200,000.
  • Three-Year Renewable Residency: Granted for real estate acquisitions with an aggregate transferred value of not less than USD 100,000.
  • One-Year Renewable Residency: Granted for property investments with a value of not less than USD 50,000.

B. Corporate Investor Residency Visa (إقامة مستثمر – GAFI)

Foreign shareholders, partners, and designated general managers establishing a registered corporate entity under GAFI (e.g., LLC, JSC) are granted specialized corporate investor residency for renewable periods ranging from one to five years. This residency is exempt from domestic labour market restrictions and authorizes family reunification visas for spouses and dependent minor children.

C. Corporate Expatriate Work Permits (تصاريح العمل)

Under Egyptian Labour Law No. 12 of 2003, international personnel employed by Egyptian corporations must secure an official Work Permit issued by the Ministry of Manpower and Immigration. Statutory rules require companies to maintain a 9:1 domestic-to-foreign employment ratio (90% Egyptian personnel, 10% foreign personnel), though exemptions may be granted by GAFI for specialized technical expertise and senior C-suite executive roles.

2. The Egyptian Citizenship by Investment (CBI) Program

Pursuant to Law No. 140 of 2019 amending Nationality Law No. 26 of 1975, Egypt inaugurated its official Citizenship by Investment Program, administered by a specialized Cabinet Citizenship Unit. The program provides four legally sanctioned investment options:

  2. Commercial Project Participation: Establishing a new business entity or investing in an existing Egyptian corporation with a minimum contribution of USD 350,000, coupled with an unreturnable direct state grant of USD 100,000.
  3. Non-Refundable State Contribution: Making a direct non-refundable donation of USD 250,000 into the centralized treasury account of the Central Bank of Egypt.
  4. Refundable Bank Deposit: Depositing USD 500,000 in a dedicated account at the Central Bank of Egypt for a duration of three years, refundable after three years in Egyptian currency at the prevailing official CBE exchange rate without accrued interest.

3. Procedural Timeline & Multi-Tier Vetting

The processing of applications by the Cabinet Citizenship Unit follows a clearly defined statutory timeline designed to ensure procedural transparency while upholding national security protocols:

  • Initial Dossier Lodgement & Escrow Deposit: Upon submission of authenticated vital records and payment of the non-refundable USD 10,000 administrative vetting fee, the applicant is granted a six-month temporary residence permit to oversee investment disbursements.
  • Comprehensive Security & Financial Vetting: The dossier is simultaneously examined by Interpol, the Anti-Money Laundering and Counter-Terrorist Financing Unit (AML/CTF), and National Security organs. This vetting is typically concluded within 90 to 120 statutory days.
  • Execution of Capital Transfer: Following initial clearance, the investor wires the requisite investment funds directly from an overseas bank account to the Central Bank of Egypt.
  • Prime Ministerial Decree & Oath: The Cabinet Unit submits the final recommendation to the Prime Minister, who issues the formal decree granting nationality. The investor and qualifying family members receive their certificates of naturalization, followed immediately by national biometric identity cards and Egyptian passports.
