Navigating Tax Inspections and Legal Appeals before Dispute Resolution Committees in Egypt

Corporate tax compliance and dispute resolution in Egypt have entered a stringent regulatory phase following the enactment of the Unified Tax Procedures Law No. 206 of 2020 and the nationwide deployment of mandatory e-invoicing and e-receipt systems. When the Egyptian Tax Authority (ETA) issues arbitrary, exaggerated, or estimated tax assessments (Form 19 Income Tax or Form 15 VAT), companies must act within strict statutory timeframes to protect their assets from administrative attachment and excessive penalties.

1. Statutory Forms and the Crucial 30-Day Objection Period

Upon concluding a tax inspection, the ETA issues statutory assessment notices:

  • Form 19 Taxes (Namuzaj 19 Dara’ib): Details the authority’s adjusted corporate income tax assessment and disputed tax bases.
  • Form 15 VAT (Namuzaj 15 Qimah Mudhafah): Issues value-added tax adjustments and associated delay fines.

Pursuant to Article 55 of Law No. 206 of 2020, the company has an absolute statutory deadline of thirty (30) calendar days from the documented date of service to file a formal objection (Tazallum). Failure to lodge the objection within this 30-day window renders the assessment final, incontestable, and immediately enforceable by administrative asset freeze (Hajz Idari).

2. Internal Appeal Committees (Al-Lijan Al-Dakhiliyyah)

Once an objection is filed, the file transfers to the Internal Committee within the competent tax office. The committee convenes specialized review sessions between the company’s legal counsel, certified tax accountant, and senior tax inspectors. If a settlement is achieved, an irrevocable reconciliation protocol (Mahdar Ittifaq) is executed, ending the dispute.

3. Statutory Appeal Committees (Lijan Al-Ta’n)

If the Internal Committee fails to resolve the dispute, the case is referred to the statutory Appeal Committee, a semi-judicial tribunal headed by an independent counselor from the State Council or judicial authorities. The Appeal Committee re-examines the technical accounting and legal validity of the assessment and issues an enforceable decision.

4. Litigation before the State Council Administrative Courts

If the Appeal Committee’s decision remains unlawful or prejudicial, the company has sixty (60) days to file an annulment lawsuit before the Administrative Judiciary Court (Mahkamat Al-Qada Al-Idari) of the State Council. The court appoints certified accounting experts from the Ministry of Justice to audit the company’s genuine ledgers and overturn arbitrary estimations.

5. Defense Strategy by Al-Hassan Law Firm

Al-Hassan Law Firm provides holistic tax controversy advocacy: auditing assessment notices, drafting technical petitions, representing corporations before Ministerial Dispute Resolution Committees, and halting bank account attachments through expedited administrative injunctions.
